Desha County Clerk Location and Contact

The Desha County Clerk's office is at 608 Robert S. Moore Avenue, Arkansas City, AR 71630. Call (870) 877-2411 before you visit to check current fees and confirm the office is open. Hours are Monday through Friday, 8:00 AM to 4:30 PM. The county seat, Arkansas City, sits along the Mississippi River in the southeastern corner of Arkansas, so plan your drive accordingly if you are coming from a distance.

Both people who want to marry must come to the clerk's office together. Each needs a valid photo ID, such as a driver's license, state ID, or passport. The clerk will issue the license after reviewing your documents and collecting the fee. State law requires a 72-hour wait after the license is issued before the ceremony can take place. The license is then valid for 60 days. If the wedding does not happen in that time, the couple must start over and pay again. No blood test is needed in Arkansas, and common law marriage has not been recognized since 1941.

Note: Both applicants must appear together in person; Desha County does not process marriage license applications by mail or phone.

Certified copies of Desha County marriage records come from the clerk's office at 608 Robert S. Moore Avenue. In person is the fastest option. Bring the names of both parties and the approximate date of the marriage, and staff can usually locate the record while you wait. The certified copy will carry the county seal and is accepted by government agencies, banks, and courts as legal proof of marriage.

Mail requests also work but take more time. Write a letter with the full names of both parties, the date of marriage, your return address, and a check or money order for the fee made out to the Desha County Clerk. Include a self-addressed stamped envelope. If the clerk cannot find the record based on what you sent, they will contact you. Turnaround for mail requests is typically one to two weeks, though it can vary.

Since 1917, the Arkansas Department of Health has maintained a statewide coupon index of marriages. These coupons confirm a marriage took place and note the county, but they are not full records. To get an actual certified copy, you must contact the Desha County Clerk or use VitalChek for online ordering. VitalChek charges a convenience fee on top of the state fee and processes orders electronically.

Desha County Historical Marriage Records

Desha County was formed in 1838 from Arkansas County and named for Benjamin Desha, a hero of the War of 1812. The county sits in the Mississippi Delta, and its early settlement drew families from the Deep South who brought their records and traditions with them. Marriage records from this antebellum period are among the most historically valuable documents in the county, and researchers frequently seek them out for family history projects.

The Arkansas State Archives holds microfilm of many early Desha County records. Some of these predate the 1917 state coupon system and cover the gaps in courthouse records. The archives staff can tell you what is available and how to request copies. For digital searching, FamilySearch has indexed a portion of Desha County's older marriage records and makes them available at no charge. The Encyclopedia of Arkansas provides historical background on the county that can help give context to names and dates you find.

Note: Some pre-1900 Desha County marriage records may be incomplete due to document loss over time; the Arkansas State Archives can help identify what survives.

Arkansas Marriage Laws and Requirements

Arkansas Code Title 9 sets marriage requirements for the whole state, including Desha County. You must be 18 or older to marry without parental consent. At age 17, you can marry with written consent from a parent or legal guardian, who must appear in person at the clerk's office when you apply. No one under 17 may marry in Arkansas.

The 72-hour waiting period starts when the clerk issues the license. Courts rarely waive it. After the ceremony, the officiant must sign the license and return it to the Desha County Clerk within 60 days. The clerk records the marriage and sends a summary coupon to the state Department of Health for the statewide index. This process, set under Arkansas Code Title 20, is how the state tracks vital events across all 75 counties.

Reading the current statutes directly is always the safest approach. The Arkansas Legislature website posts the full text of every state code chapter, including Title 9 on domestic relations and Title 20 on vital records. If you have a specific legal question, consult an attorney. The clerk's office can tell you what documents you need, but staff cannot give legal advice.
